CONSTANTLIGHT – END USER LICENSE AGREEMENT (EULA)

1. SUBJECT – ConstantLight analyses Sony RAW files (.ARW) and writes Adobe Lightroom Classic settings as XMP sidecar files. Other cameras and applications are not supported. Image files themselves are never modified.

2. LICENSE – You receive a non-exclusive, non-transferable right to use ConstantLight on one computer for the purchased term (normally 12 months from activation), including commercial use. The license is activated online once and bound to this computer; it can be moved via "Transfer license". The license ends after the term – NO automatic renewal, no recurring charge. XMP files already written remain usable. You may not rent, resell or share the software, circumvent the license check, or modify, decrypt, decompile or reverse-engineer the software or its model files, except where mandatory law permits.

3. BACKUPS – XMP files may be overwritten if you enable that option. You are responsible for backing up your images, XMP files and Lightroom catalogs before use. Results are software suggestions; check them before delivering to clients.

4. SYSTEM – Windows 10/11 (64-bit); 16 GB RAM and an NVIDIA GPU recommended. The software uses CPU, GPU and memory heavily during processing and adapts to your system. You are responsible for adequate cooling and stable operation of your computer.

5. WARRANTY – Statutory warranty rights apply. Error-free results for every lighting situation, camera firmware or Lightroom version cannot be guaranteed.

6. LIABILITY – We are liable without limitation for intent and gross negligence, injury to life, body or health, under product liability law and under any guarantee given. For slight negligence in breaching an essential contractual obligation, liability is limited to typical, foreseeable damage, at most the license fee paid. Otherwise liability for slight negligence is excluded, in particular for data loss, lost profit, hardware failure, computer damage or re-editing effort. For data loss we are only liable for the effort that would have been required with proper backups.

7. PRIVACY – ConstantLight works offline. Your images and client data are processed on your computer and never sent to us or third parties. Only when activating, renewing or transferring the license are the license key, an anonymous device ID, the program version and a timestamp sent to our license server. 8. PURCHASE, WITHDRAWAL – Purchases are made on our website (payment processed by Stripe) under the terms agreed there. Consumers' statutory right of withdrawal expires for digital content once they have expressly agreed to immediate performance and acknowledged the loss of that right.

9. TRADEMARKS – Sony, Adobe, Lightroom and NVIDIA are trademarks of their respective owners. ConstantLight is not affiliated with them.

10. FINAL PROVISIONS – German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this applies only insofar as mandatory consumer protection law of their country of residence does not provide otherwise. If any provision is invalid, the remainder stays in effect.
